Welcome to DaftarBiryani, operated by DaftarBiryani ("we", "us", "our"). By placing an order through daftarbiryani.com, you ("Customer", "you") agree to these Terms and Conditions. Please read them carefully before ordering.

1. The Preorder Model

DaftarBiryani operates exclusively on a preorder basis. Every order is cooked fresh only after it is placed and payment is confirmed. By placing an order, you acknowledge that:

Orders must be placed before 6:00 PM for next-day delivery.
Orders placed after 6:00 PM are queued for the following available delivery day.
You may preorder up to 3 days in advance.
Delivery is available 7 days a week across our delivery zones in Bengaluru.

2. Cancellation Policy

All orders are made to order. Once an order is confirmed and payment is received, it cannot be cancelled under any circumstances. No cancellations will be accepted after payment is processed.

This policy exists because we begin sourcing fresh ingredients and allocating kitchen capacity immediately after your order is confirmed. We are unable to recover these costs if an order is cancelled.

3. Refund Policy

As a general rule, all sales are final and no refunds are issued. Exceptions are considered only in the following circumstances:

Non-delivery: If your order is not delivered due to an error on our part (not including incorrect address provided by you or access restrictions at your delivery location), we will offer a full refund or priority re-delivery at our discretion.
Payment errors: Duplicate charges or technical payment errors will be refunded in full within 7 business days upon verification.
Significantly incorrect order: If the order delivered is materially different from what was placed, contact us within 2 hours of delivery with photographic evidence. We will review and respond at our discretion.

Refund requests must be made by contacting us at mithun.associated@gmail.com within 24 hours of the scheduled delivery time. Refunds, if approved, will be processed within 7 business days to the original payment method.

The following are not grounds for a refund: change of mind, incorrect delivery address provided by the customer, delivery delays caused by traffic or weather, taste preferences, or delays caused by the logistics partner.

4. Service Level Agreement (SLA)

We are committed to delivering your order in the best possible condition. The following represents our best-effort service standards:

Delivery window: Orders are targeted for delivery by 1:00 PM on the selected delivery date.
Food quality: All food is cooked fresh that morning using quality ingredients. We take every reasonable precaution to ensure food safety and temperature during packaging.
Packaging: Orders are sealed to maintain freshness during transit.

Important: Delivery time and food temperature upon arrival are subject to factors beyond our control, including traffic conditions, distance, weather, access restrictions at the delivery address, and the logistics partner's operations. We do not guarantee a specific delivery time or food temperature at the point of receipt. These factors are entirely outside our control once the order leaves our kitchen.

We are not liable for any degradation in food quality, temperature, or condition arising from delivery delays caused by third-party logistics partners or external factors.

5. Delivery

Delivery is handled by Porter or equivalent third-party logistics partners.
The delivery charge is passed through to you at actual cost — we do not mark up delivery fees.
Delivery is currently available to: HSR Layout, Koramangala, JP Nagar, BTM Layout, Jayanagar, and surrounding areas in Bengaluru.
You are responsible for ensuring someone is available to receive the order at the delivery address. Failed deliveries due to your unavailability are not eligible for refunds.
Providing an incorrect or incomplete address that results in failed or delayed delivery is your responsibility.

6. Food Safety and Allergens

Our food is prepared in a home kitchen environment. We use common ingredients including gluten, dairy, nuts, and spices. We cannot guarantee the absence of allergens. Customers with allergies or dietary restrictions must exercise their own judgement. We are not liable for any allergic reactions or health issues arising from consumption of our food.

7. Payments

All payments are processed through Razorpay, a third-party payment gateway. By placing an order, you agree to Razorpay's terms and conditions. We are not responsible for any payment failures, delays, or errors arising from Razorpay's systems. In case of a payment dispute, please contact us and we will coordinate with Razorpay on your behalf.

8. Limitation of Liability

To the maximum extent permitted by applicable law, DaftarBiryani shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from or related to your use of our service, your order, or the delivery of your food. Our total liability for any claim shall not exceed the value of the order in question.

9. Force Majeure

We shall not be liable for any failure or delay in performance of our obligations where such failure arises from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, power outages, civil unrest, pandemic conditions, strikes, or failures of third-party infrastructure including logistics and payment systems.

10. User Obligations

By placing an order, you confirm that:

The information you have provided (name, phone, address) is accurate and complete.
You are placing the order for lawful purposes.
You are 18 years of age or older.
You have read and accepted these Terms and our Privacy Policy.

11. Intellectual Property

All content on daftarbiryani.com, including the DaftarBiryani brand name, logo, tagline ("Biryani for the office"), and website design, is the intellectual property of DaftarBiryani. Unauthorised reproduction or use is prohibited.

12. Amendments

We reserve the right to amend these Terms at any time. Changes will be posted on daftarbiryani.com. Continued use of our service after changes are posted constitutes acceptance of the revised Terms.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of India. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka, India.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
